Terms & Conditions
By accessing the Port Aransas public wireless network, you agree to the following terms and conditions of use.
Please note, users under 13 years of age are not allowed to access the wireless network. Users between the ages of 13 and 18 years may only use the wireless network under the supervision of a parent or legal guardian who agrees to be bound by these terms and conditions.
Terms & Conditions:

The public wireless network is a free and voluntary service provided by the Port Aransas Tourism Bureau & Chamber of Commerce (from here on referred to as “Port Aransas”*) and is completely at their discretion. Your access to the public wireless network may be blocked, suspended, or terminated at any time for any reason, including but not limited to: violation of these terms and conditions, actions by me that may lead to liability for Port Aransas, actions by me which violate the rights of the aforementioned entities or of any other third party, or actions by me which violate any federal, state, or local law.

The user agrees not to use the public wireless network for any purpose that is unlawful and takes full responsibility for their actions.

The public wireless network is provided “as is” without warranties of any kind, either expressed or implied.

This network is not intended to allow for unlimited access to the entire Internet. This means, in part:

The user agrees to refrain from any use which could put public order and safety or morality at risk or which violates laws and molests or frightens other Internet users.

The user agrees not to use this Internet access for file sharing programs.

The user agrees not to use bandwidth excessively (i.e. for video/audio streaming, voice-over-ip (voip) services, online gaming, etc.), since their Internet access is shared with other users.

The user is familiar with the risks of the Internet, and they alone shall be responsible for their protection (i.e. an up-to-date anti-virus program, non-starting of suspicious programs/files, etc.). Port Aransas will not accept any liability for faults, interferences or damages arising from using the Internet via the wireless service or configuration changes of the end device by the user.

Port Aransas does not guarantee that the service offered will be available without interruption and/or that the desired connections can always be established or maintained.

The user understands that they will be using their electronic equipment in a public area and that privacy cannot be guaranteed.

The user is solely responsible for connecting and configuring their own equipment, and under no circumstances will Port Aransas or any of its officers, directors, employees, agents or affiliates be liable for any legal damages (whether based on tort, breach of contract, or equitable theories) based on any claim by the user, or any of their heirs, assignees, appointees, or successors-in-interest, and arising out of or as a result of their use or that of permissive users of their computer of this wireless network.

The user agrees that the technical data of their end device (i.e. MAC address, IP address, device type, etc.) are stored and analyzed by Port Aransas for the purpose of interference suppression and bandwidth control.

The public wireless network is unencrypted and unfiltered. Use of the public wireless network is done at the user’s own risk. By using this wireless network, the user acknowledges that security errors and hacking are an inherent risk associated with any wireless service. For that reason, the user expressly agrees that they knowingly assume such risk, and further agree to hold Port Aransas harmless from any claim or loss arising out of, or related to, any such instance of hacking or other unauthorized use or access into the user’s computer.

It is strongly recommended that the user not use the public wireless network to transmit personal, financial, or legal data. It is not possible for Port Aransas to protect the user against malicious theft or interception of such data transmitted over our public wireless network.

The user agrees that the email provided for access to the wireless network may be used by Port Aransas for e-mail marketing and promotional purposes. The user may unsubscribe at any time.
In case of violation of these conditions for use, the Port Aransas Tourism Bureau & Chamber of Commerce reserves the right to block individual end devices (i.e. laptops, tablets, mobile phones, etc.) for use of this wireless network.
The user agrees to the above terms and conditions as well as the following statement:
Notwithstanding anything to the contrary contained herein, I hereby declare that, prior to the execution of this release, I have apprised myself of sufficient relevant information regarding the Port Aransas public wireless network in order to intelligently exercise my judgment in deciding whether to execute this agreement and further declare that my decision to do so was not based on or influenced by any declaration or representation of Port Aransas.
By accessing the Port Aransas public wireless network I hereby assume full responsibility for any and all risks and for any and all claims, actions, liability, losses, damages, suits, causes of action, demands and expenses (including, but not limited to, attorney’s fees) for bodily injury, illness, death, property or economic loss or any and all other damages (collectively “Losses”) incurred by me or arising out of or in connection with my use of the Port Aransas public wireless network and do knowingly and voluntarily expressly release, waive and discharge, indemnify, defend and hold harmless Port Aransas from any and all Losses, arising in any manner out of or in connection with my use of the Port Aransas public wireless network, REGARDLESS OF ANY ACTUAL OR ALLEGED NEGLIGENCE (WHETHER SOLE, JOINT, COMPARATIVE, CONTRIBUTORY, ACTIVE, PASSIVE OR OTHERWISE) STRICT LIABILITY, OR OTHER FAULT OR CONDUCT OF ANY OF THE INDEMNIFIED PARTIES. The risks assumed include all risks which may not now be foreseeable or within the reasonable contemplation by me or any of the Indemnified Parties.
Port Aransas retains the right to amend this Public Wireless Network Terms & Conditions Policy as needed.
*The term “Port Aransas” includes the Port Aransas Tourism Bureau and Chamber of Commerce and their agents, principals, servants, representatives, board members, council members, officers, directors, attorneys, employees, employers, successors, and assigns, collectively the “Indemnified Parties.”
